Brain injury litigation is an emerging and complex field of law. Our attorneys have vast experience and understand the intricacies of traumatic brain injury (TBI).
Brain injury cases are hard for juries to understand because they cannot directly observe the injury. However, people with brain injury often experience many difficulties including trouble communicating,, struggles with accurate judgment, personality changes, and short -term memory loss. These complications greatly diminish their quality of life.

Before the formation of MDR, our attorneys had many notable verdicts and settlements involving traumatic brain injury.
In 2003, a 16-year-old girl was a passenger in a vehicle that was struck by a fire truck. She was in a coma for three weeks, and awoke to a drastically different life. Once an honor student, she suffered permanent cognitive defects from brain injury. Al Durkin settled with the host driver for $2.1 million. The case against the Fire Protection District went to trial, and the client was rewarded the highest motor vehicle accident jury verdict ever in Kane County in the amount of $6.5 million.
Another case involved a Chicago construction worker in his mid-fifties who fell 20 feet to the ground landing directly on his head. The client was disabled from traumatic brain injury and was unable to work in order to support his family. The client settled for $7.5 million after the attorney proved the extensiveness of the client’s brain damage.
