MDR LAW LLC Representing Veteran in Premises Liability Case

Jewel Osco MDR LAW

MDR LAW LLC is representing Kevin Qin in a premises liability case against Jewel Osco grocery store. In this blog, we discuss the incident in further detail as well as the legal action we are taking against the store for its negligence in maintaining a safe environment for customers.

What Happened to Our Client?

Our client, Kevin Qin, an Iraq War Veteran, was brutally attacked by a large group of individuals at a Jewel Osco grocery store in the South Loop of Chicago. The attack occurred when Qin was entering the store. He had no warning, as the group descended immediately and punched and kicked him repeatedly.

This unprovoked attack left Qin with physical injuries to his wrist, elbow, and knee, as well as headaches and nausea. The severity of the assault caused him to briefly black out during the incident.

Pursuing Civil Action

The assault not only warrants criminal action due to the violent nature of the attack but also raises the possibility of a personal injury suit, specifically a premises liability suit, against the store where the incident occurred. Premises liability refers to the legal responsibility of property owners to ensure the safety and well-being of individuals on their premises.

In this case, Jewel Osco may be held liable for failing to provide adequate security measures or intervene to prevent the attack on Qin within their store. In our court filing, we highlight that:

  • The store, through its employees and agents, should have known or had knowledge of the group of assailants presence on its premises as well as the danger they presented to the plaintiff.
  • The store had a duty to take reasonable action to protect its lawful patrons, including Kevin Qin, from foreseeable dangers, including the predictable violence of the group gathered at the store’s entrance.
  • The store is guilty of failing to: maintain order and control for the safety of its patrons, remove a group that loitered on their property, provide adequate warning to patrons (including our client) about the risk the group presented, hire, train, and supervise competent security personnel for their business, and allowed the disorderly, dangerous group to remain on their property despite the foreseeable risk they presented to others.
